Down’s man wins £10k after council bans sex with wife
A MAN with Down’s syndrome has been awarded £10,000 in damages after his local council ordered his wife to stop having sex with him.
The 38-year-old man, who cannot be identified, had been having “normal” sex with his spouse of five years, a judge said.
But an assessment by a council psychologist found that the man, who also has a RULING Court Of Protection learning disability, did not have the mental capacity to consent. The couple were told to abstain from sex until the man was given sex education but his course was delayed for a year, the Court Of Protection in London heard. In a ruling yesterday, Sir Mark Hedley said the man’s human rights had been breached through “deprivation for at least 12 months of normal conjugal relations with his wife”.
