Widow sues the NHS for ‘loss of the services of her husband’

£500k claim over ambulance death

A WOMAN whose husband was fatally injured by an ambulance is suing for the “loss of his services”.

Retired dentist Michael Daly, 77, was hit by the vehicle’s wing mirror on a crossing as it attended a 999 call.

Now widow Roseline, 77, wants £500,000 for the “loss of his services as a loving husband”.

She says she was financiall­y dependent on him and has suffered post-traumatic stress since his death.

Her High Court claim includes the cost of paying a profession­al for household tasks previously carried out by Dr Daly.

Her lawyer, Sam David, said: “Most of the claim is for continued loss of earnings and pension.

“And because he is not there any more you can claim for some of the cost of getting a profession­al to do the things he would have done. “But there’s also the claim for the loss of the love and affection of a husband. “It’s hard to precisely value it but in claims like this it’s typical to allocate several thousands in respect of the loss a spouse receives.” The case has not yet been heard by a judge. Dr Daly was hit by the ambulance in his home village of Danbury, Essex in February 2016. He was taken to hospital but died 17 weeks later after contractin­g MRSA and suffering a cardiac arrest. Paramedic Faye Parson, 41, was cleared at Chelmsford crown court last July of causing death by careless driving. East of England Ambulance Service declined to make any comment.
