Mogul Weinstein tries to get sex attacks case dismissed
DISGRACED Hollywood mogul Harvey Weinstein is seeking a dismissal of his sex crimes case, court papers show.
Lawyers claim prosecutors did not give the grand jury evidence of a “longterm, consensual, intimate relationship” with one of his accusers.
The motion also claims the district attorney failed to give adequate notice of more serious charges and argues a five-year statute of limitations has passed on one charge. It further claims a “failure to provide sufficient evidence of the legally required element of force”. Weinstein’s lawyer Ben Brafman said: “The motions reflect the first opportunity for Mr Weinstein to present legal arguments as to why the indictment should be dismissed.” The producer, 66, faces charges of sexually assaulting three women and could be jailed for life.
