Sheriff leaves thugs laughing on the other side of their Facebook

Brutal brothers who took selfies during their assault trial are caged

TWO thugs who posted smirking selfies of themselves outside court as they stood trial for a brutal attack had the smiles wiped off their faces yesterday – when they were caged for more than six years.

Brothers Graham and Craig Cavin punched and kicked Charles Lamont on the head and body in a “sustained, violent” assault after the christening of his nephew Logan Middleton.

The assault by the pair, who were friends of the baby’s father, happened at the party that followed at Dundee’s Downfield Junior FC social club.

The pair had claimed they were “remorseful” but a sheriff told them their Facebook antics during the trial meant he “wasn’t taken in” by their “worthless comments”. That attack was sparked by Charles complaining about the way Mark Leggatt, 26 – who was cleared of involvement in the assault – was dancing with his mum.

Fiscal depute Eilidh Robertson told Dundee Sheriff Court the christening had been a “lovely,

happy day” until then. She added: “Fast forward a few beers, and Charles Lamont is the victim of a completely unprovoked assault” which left him “with a nasty, nasty injury which leaves him impaired even to this day”. Graham Cavin, 19, of Lawton Road, Dundee, and Craig Cavin, 26, of Kirkton Road, Dundee, were found guilty of assaulting Charles to his severe injury and permanent impairment.

Craig Cavin also admitted a baseball bat attack in the city centre months after the christening assault.

Sheriff Tom Hughes jailed Graham Cavin for two-and-a-half years, while Craig Cavin got three years and nine months for his two offences.

He said their “remorse was very hard to accept and reconcile with the stupid behaviour you both got involved in during the trial”.

He added: “You were outside court taking selfies, posting stuff on Facebook, making comments during the course of the trial. I’m not taken in by the worthless comments from you in the social work reports.

“During the incident you acted like animals – it was like a nature programme where a pack descends on its prey and attacks. The courts cannot tolerate that.”
