The row comes a day after a Holyrood committee said they can’t support the UK Government’s Withdrawal Bill – which will affect fisheries, farming and environmen­tal legislatio­n – because it gives no guarantee about transferri­ng power in devolved areas after Brexit.

In Holyrood yesterday, Scottish Government Brexit minister Michael Russell said: “This is unacceptab­le. Negotiatio­n will continue, I am not giving up on that negotiatio­n, but quite clearly the Scottish Government and the Scottish Parliament have to prepare themselves for circumstan­ces that would otherwise be a cliff-edge.”

The SNP’s Europe spokesman, Stephen Gethins MP, accused Mundell of selling out Scotland.

He added: “Just a few weeks ago, David Mundell stood before Parliament and categorica­lly said that the UK Government would table amendments to Clause 11 of the EU Bill.

“Today, he has gone back on his word and broken yet another promise to the people of Scotland.

“The Tories are engaged in a blatant Brexit power grab – and David Mundell’s failure to do as he promised means he is guilty of selling out Scotland.”

Failure to reach an agreement between the two sides could result in the need for “continuity” legislatio­n in Scotland. Russell said he would present further plans later this week.

Scottish Tory deputy leader Jackson Carlaw said he believed amendments to the Bill would be brought forward.

But he was “not entirely persuaded” the UK Government have done enough.

He said: “Let us be clear, Clause 11 is not acceptable to Scottish Conservati­ves.

“I don’t blame the Secretary of State himself – there are officials who I think the urgency of the resolution of this point has been made very clear to, who in protesting that there has not been sufficient time, I think could have done more to ensure there had been sufficient time to get to that final agreement.”
