Disabled lawyer to sue DWP over cut in benefit

PIP case could open floodgates

BY ARTHUR VUNDLA A LAWYER is suing the Department for Work and Pensions for disability discrimina­tion in a case believed to be the first of its kind in Scotland.

Daniel Donaldson, from Glasgow, has lodged a civil action at the city’s sheriff court. He is seeking compensati­on for his disability benefit being incorrectl­y stopped.

He believes his case, if successful, will open the floodgates for other disabled people to do the same.

Daniel, 37, suffers from depression, anxiety and a number of other health problems.

The solicitor said: “I raised this action because I’m sick and tired of the way our politician­s are treating disabled people. missed out on. But Daniel is now seeking £4000 for disability discrimina­tion, as well as £275.34 for bank charges he incurred during that time and £700 for other lost benefits.

The DWP confirmed earlier this year that they would review PIP claims after a court ruling stated that the disability benefit was unfair to people with mental health conditions.

A spokeswoma­n said they couldn’t comment on Daniel’s case as the legal action is ongoing. But she added that the department were “absolutely committed” to ensuring disabled people get the support they need.

MSPs passed legislatio­n last week to establish a devolved Scottish social security system, which will include control of PIP.

A Scottish Government spokeswoma­n said: “When we begin delivery of disability benefits, we have categorica­lly ruled out requiring anyone to undergo a disability benefit assessment by the private sector.”
