..and BoJo is up against another court challenge

BORIS Johnson’s EU deal would be unlawful and should not be voted on by MPs, according to a legal challenge submitted to the Court of Session.

Good Law Project founder Jolyon Maugham QC, who was behind the successful bid to overturn the suspension of Parliament, has submitted the emergency legal bid in the Scottish courts.

The Prime Minister and European Commission president Jean-Claude Juncker yesterday announced a “great new deal” for Brexit, ahead of an EU summit in Brussels. The deal is expected to go before MPs tomorrow.

However, Maugham said it would contravene legislatio­n that prevents Northern Ireland from BY PAUL HUTCHEON having different customs rules than the rest of the UK.

The petition is expected to be heard today.

Maugham said: “We do not understand how the Government might have come to negotiate a Withdrawal Agreement in terms that breach amendments tabled by its own European Research Group.

“If the proposed Withdrawal Agreement is unlawful, the Government will be obliged to request an extension as mandated by the Benn Act and in accordance with undertakin­gs given to the Court of Session in Vince, Maugham, Cherry v Boris Johnson.” If the vote fails then the Prime Minister legally must ask the EU for an extension after MPs passed the Benn Act. But Johnson has said he will take the UK out of the EU on October 31 with or without a deal.

There is a court case in progress seeking to stop the PM ignoring the act.
