SCOTLAND SICKEST FRAUDSTE

-

A DRUG dealer’s sister tried to stop his home being seized in a proceeds of crime swoop – by claiming it was her property.

Farzana Ashraf tried to overturn a confiscation order imposed on Mohammed Younas after he was jailed for 10 years for flooding Scotland’s streets with heroin.

But her bid failed – and the £120,000 flat in Edinburgh’s Polwarth area will be seized by prosecutors.

The pair’s sister Ruksana Ashraf was branded Scotland’s worst serial fraudster after making fake insurance claims related to the Grenfell Tower fire and two deadly terror attacks. The sick con artist was jailed for three years in December 2018 after trying to claim £180,000 in payouts.

Ruksana was initially part of the family’s bid to keep Younas’s Edinburgh flat and was named in court papers back in 2014.

Younas, 49, was convicted at the High Court in Glasgow in 2012.

Lord Pentland made a confiscation order in the sum of £126,000, of which

BY ANDY SHIPLEY andy.shipley@reachplc.com £121,000 was in respect of his flat in Edinburgh.

Farzana claimed that she was the true owner of the property and had paid the mortgage since 2003.

In 2018, the Court of Session ruled that Farzana failed to take the steps necessary to transfer the title from her brother to her, meaning there was “no basis” on which to exclude the flat from the order made under the Proceeds of Crime Act 2002.

She applied to have the case heard at the UK’s highest court in London.

However, three Supreme Court justices have now refused her permission to appeal application after ruling it did not “raise an arguable point of law”.

Farzana said she had an arrangement with Younas’ bankruptcy trustee to buy the equity in the property and since 2003 had serviced the two secured loans over the property.

But at the Court of Session, Lady Wise ruled that Farzana had failed to provide evidence that she had been paying the loans.
