TWO former paratroopers were subjected to “highly offensive” racial harassment, an employment judge has ruled.
Nkululeko Zulu and Hani Gue alleged the Army did not take reasonable steps to prevent their ordeal at a barracks.
A tribunal heard that someone had drawn a swastika, a Hitler moustache and the words “f*** off” and “n ***** s” on photographs of the men.
Judge Richard Baty said this graffiti was “unquestionably related to race”.
The men’s solicitor Amy Harvey said: “The claimants have succeeded in establishing their claim against the MoD that they suffered racial harassment during their time in the Army and that the MoD did not take all reasonable steps to prevent such harassment.
“The claimants intend to seek compensation and recommendations from the tribunal that the MoD implement better equality and diversity training within the armed forces.” A LAWYER was stabbed to death with a screwdriver by a teen yob for raising his arm to let him past.
Peter Duncan, 52, was “simply in the wrong place at the wrong time” when he got in the 17-year-old’s way as the thug was about to confront another youth.
The solicitor, who was on his way to catch a bus home from work, raised his arm to let the lad past. But the teenager “took exception” and grabbed him.
As Mr Duncan pushed him away the boy thrust the screwdriver he had stolen earlier from Poundland into his heart. He collapsed and died later in hospital.
Yesterday the yob – who cannot be named because of his age – pleaded guilty to murder, theft and possessing an offensive weapon at Leeds Crown Court.
He appeared in court via videolink from a young offenders’ institution. Sentencing was adjourned for reports.
Mr Duncan, of Benton, Newcastle upon Tyne, was attacked outside a Greggs Bakery in the city at 6.20pm on August 14.
His family described him as a “devoted father, husband, son, brother, uncle and friend and loved by all who knew him”.
