‘Proof Maddie is dead’

But top judge says: It’s just police theory

A GERMAN prosecutor last night said he has evidence that Madeleine Mccann is dead.

Hans Christian Wolter claimed the authoritie­s need more informatio­n to find missing Madeleine’s body.

But he added: “After all the informatio­n we got, the girl is dead. We have no informatio­n that she is alive.

“All indication we have got that I can’t tell you points in the direction that Madeleine is dead.”

Mr Wolter said that the police do not have enough “hard evidence” to put suspect Christian Brueckner on trial.

But he added: “We got things we cannot communicat­e that speak for the theory that Madeleine is dead, even if I have to admit that we don’t have the body.”

It came as a top judge said Madeleine may be alive – and the German police theory she was murdered was an “investigat­ors’ hypothesis”.

Ex-federal judge Dr Thomas Fischer said: “You don’t know whether the child is dead or not. There are certain plausibili­ties that derive from criminal experience but which I think are spread with a certain unpleasant undertone also by the investigat­ive authoritie­s. If the public prosecutor knew more, they would say more.’’

The Met Police – which has spent nine years probing Madeleine’s disappeara­nce from a holiday flat in Portugal’s Praia da Luz on May 3, 2007 – is still treating the case as a missing person inquiry.

Yesterday Mccann family spokesman Clarence Mitchell said: “Kate and Gerry have maintained from day one that they believe that Madeleine could still be alive.”

Last night German police released pictures of Praia do Barranco beach, where Brueckner parked his camper van, and a restaurant in Foral on the Algarve where he worked.
