Nurse denies sex assaults

HE DENIES TOUCHING THREE WOMEN WITHOUT THEIR PERMISSION

A DERBY nurse sexually assaulted two patients and a colleague while working at two different hospitals, a jury was told.

Jolin Tirol touched two of the women between their legs and another on the bottom, Derby Crown Court heard.

The 43-year-old, of Mackworth, left one victim “crying uncontroll­ably” after pulling her towards him in a lift at the Royal Derby Hospital, the prosecutio­n claims.

And he moved his hands up the leg of a different woman as she lay in bed recovering from an operation and brushed it against her crotch, it is alleged.

Tirol has been charged with three counts of sexual assault against three different women. He denies all three charges.

Prosecutor Sarah Allen, opening the trial, said: “All of the incidents occurred while the defendant was working as a nurse, each involved inappropri­ate touching and the prosecutio­n say there were some common features.”

Miss Allen said one offence happened in 2017 when Tirol was working in the accident and emergency department of the Royal Derby Hospital.

She said a female colleague who had never worked with him before told him about back pain she suffered and he said he knew reflexolog­y.

Miss Allen said they were alone together in a side room and he began massaging her hand and then her back. She said: “It made her feel uncomforta­ble and she told him to stop and his response was to tell her ‘just relax.’ “She was trapped and she says he then moved his hand under her dress and towards her breasts.

“She told him to get off her and put her own hands over his to stop him moving them.

“He was not fazed by this and told her to ‘chill.’

“He tried to kiss her and she told him to stop but he managed to get one of his hands to touch her between the legs (over clothing).

“She was later described as visibly upset and was sent home early.”

Miss Allen said that woman reported what had happened to her that night to another colleague and the hospital referred it to the Nursing and Midwifery Council to investigat­e.

She said the police became involved and as part of their investigat­ion they asked the hospital to look back at their records and see if any similar matters had been reported against Tirol.

Miss Allen said that is when the second incident was found. It dated from 2012 and involved a female patient at the same hospital. She said on that occasion Tirol and the woman were having a cigarette outside and he pulled her towards him and touched her bottom.

Miss Allen said: “She pushed him off and they got in a lift together and he did the same thing.

“By the time she got back to her ward she was crying uncontroll­ably.”

She said the third incident involved a patient at the Queen’s Medical Centre, Nottingham, where Tirol was working as an agency nurse in 2017.

Miss Allen said as she lay in her bed the woman’s husband was rubbing her feet as she found that soothing.

She said Tirol, of Battersea Park Way, walked in and said he would massage the woman’s feet later as he was “good at it”.

Miss Allen said: “Later that evening, after her family had gone home, the defendant came to her bedside, pulled the curtains shut and said to her ‘my mum taught me how to do this’ and began massaging her feet.

“She was shocked by this and he moved his hand up her leg and brushed against her crotch. She tried to get away by moving up the bed but this hurt due to the tubes in her body from the operation.

“She told him to stop and he told her to be quiet and put his hand inside her nightdress and touched her breasts.”

Miss Allen said Tirol was interviewe­d three times by the police about the allegation­s.

She said: “He denied he touched his colleague inappropri­ately, said the 2012 victim had taken medication which made her hallucinat­e and that the third victim was on a high dose of morphine and denied touching her sexually.”

Giving evidence, the first alleged victim said she was in a side room at Royal Derby Hospital and that she had complained to Tirol about back pain.

She said he told her he had recently done a course in reflexolog­y and she allowed him to start massaging her hand and then up her arm and towards her shoulder.

The woman, whose identity is protected by law, said: “He placed his hands at the top of my chest and I placed my hands over his hands.

“I asked him to stop and he said ‘okay’ and I let go so he could move his hands.

“He the forced his hand down, cupping my breast.”

Judge Shaun Smith QC asked: “Did he have your permission?”

The woman replied: “No, your honour.”

The trial continues.

She told him to get off her and put her own hands over his to stop him moving them.
