Nurse sex assault trial told ‘victim looked visibly upset’

A WARD sister at the Royal Derby Hospital has told how a colleague described to her how she had been sexually assaulted by a nurse.

The witness said the alleged victim “looked physically upset” as she told her how Jolin Tirol placed his hand on her chest and then moved it up her thigh.

The sister added that the woman told her she had not given her consent for the 43-year-old, of Mackworth, to touch her in this way and that she “wanted to go home”.

Tirol is on trial at Derby Crown Court after being charged with three counts of sexual assault against three different women – the nurse and two patients.

He denies all three charges. The ward sister told the jury she

was on her break during her shift on the night of the alleged incident in the summer of 2018.

Asked by prosecutor Sarah Allen to describe what happened, she replied: “She (the alleged victim) came in, she looked physically upset, her eyes were bloodshot.

“She just looked like somebody that was either about to cry or had been crying.

“She said, ‘please may I have a word with you?’ and I said ‘would you mind if I finished my break?’

“She said it was something that could not wait and could she speak to me now?”

The witness said they moved to a room where they could be alone and the alleged victim asked if she could go home straight away.

But the ward sister said she needed to know why before allowing her to do so.

The witness said: “She started to cry and became upset, she told me Mr Tirol had touched her inappropri­ately.

“She said she had been having problems with her hands and feet and that he told her he has studied reflexolog­y and could massage her.

“She said he was massaging her hands and then moved his hand up her arm and on to her chest and she asked him to stop and he told her to relax.

“She said that he also began touching her leg and moved his hand underneath her dress ,at which point she tried to stop him. She said she had not consented to that.”

Miss Allen, opening the trial on Tuesday said Tirol, of Battersea Park Way, worked as a nurse at both the

Royal Derby and the Queen’s Medical Centre, in Nottingham. She explained to the jury that the crown’s case is that he sexually assaulted the nurse and one patient at the former and a second patient at the QMC.

Miss Allen, opening the trial, said: “All of the incidents occurred while the defendant was working as a nurse, each involved inappropri­ate touching and the prosecutio­n say there were some common features.”

She said Tirol was interviewe­d three times by the police about the allegation­s.

She said he denied he touched the nurse inappropri­ately. She said the second victim had taken medication which made her hallucinat­e and that the third victim was on a high dose of morphine and denied touching her sexually.

The trial continues.
