Child was in cuffs

A woman who admitted restrainin­g a child with handcuffs has been handed down a community payback order.

Kelly Rae, 35, appeared for sentence at Hamilton Sheriff Court after pleading guilty to a reduced charge of assaulting the young child at a house in East Kilbride by slapping her on the head and restrainin­g her while she was handcuffed on December 3.

Co-accused Stephen Rae, 34, had a not guilty plea to holding the child down and handcuffin­g her accepted by the crown at an earlier hearing.

The fiscal depute previously told the court that the child had become disruptive and was throwing things about.

He said: “The complainer ended up on a bed and the accused tried to restrain her, striking her on the head.

“She then called on the coaccused to bring handcuffs, which appear to be proper, rigid, police-style handcuffs.

“The complainer kicked out at the accused, kicking her in the stomach twice.

“The complainer’s right wrist was placed in the handcuffs and the accused restrained her.

“She was handcuffed over hand rather than to something.

“The handcuffs were forced shut and the complainer was crying saying they were painful and asked for them to be taken off. They were on for about two minutes.”

Rae was spared a jail sentence but was placed on supervisio­n for two years and was also given a conduct requiremen­t.

The court also ordered her to attend a child psychology course.
