Ear-bite man jailed

‘His mother realises that he has a debt to pay to society’

A MAN who bit a 4cm chunk out of the ear of his ex’s new boyfriend has been jailed.

Alan MacMillan, 36, was jailed for 18 months at Dundee Sheriff Court after admitting assault to severe injury.

The court heard MacMillan carried out t he savage attack on Ryan Rosscraig, 33, in his own home in Dundee.

Fiscal depute Eilidh Robertson said MacMillan and his ex, Nicola McAndrew, were drinking at a mutual friend’s house on the evening of August 13.

The fiscal said: “The accused became angry when Miss McAndrew began to speak about her new partner and left the friend’s home stating he was going to knock out Mr Rosscraig.”

He stormed over to Mr Rosscraig’s home and entered, followed by Miss McAndrew.

Mr Rosscraig was lying on the sofa and MacMillan punched him twice on the face, without warning.

The fiscal said: “The accused then climbed on top of Mr Rosscraig, straddling him, while continuing to punch him on the head.

“The accused then leaned in towards Mr Rosscraig and bit him on the ear.”

Miss McAndrew pulled MacMillan off Mr Rosscraig and 10 minutes later he agreed to leave.

Police officers attended and found Mr Rosscraig inside his flat with a “significan­t bite wound” to his ear, a section of his ear missing and swelling to his face.

MacMillan was traced outside a block of flats on Court Street North.

MacMillan, a prisoner at Perth, admitted assaulting Mr Rosscraig by repeatedly punching him on the head and biting his ear to his severe injury and permanent disfigurem­ent at Court Street North on August 13.

Solicitor David Duncan, defending, said: “His mother realises he has a debt to pay to society.

“She is watching from afar as his mental health deteriorat­es.”

Sheriff Alastair Brown imposed an 18 month jail sentence and added: “Not only did you assault a man but you went to where he was for that purpose — you didn’t just lash out at him.”
