OAP, 65, charged over dog ‘attack’
A PENSIONER has been charged with having an outof-control dog that bit a child, leaving the youngster with a gaping leg wound.
Robert Wallace, 65, of Fintry Drive, was reported to the procurator fiscal following a police probe into an incident in his home street in December.
He has now appeared at the city’s sheriff court after a charge was brought in relation to the matter.
It is alleged that on December 1, at a grassy area near to the shops in Fintry Drive, Wallace’s dog — named Zappa — was dangerously out of control and bit the youngster on the leg to the child’s severe injury.
It’s understood the youngster — who cannot be named for legal reasons — had to have surgery on the injury. Wallace, who l ooked frail during his court appearnace and had to be helped into the court by relatives, appeared in private on a petition before Sheriff Alison McKay.
He made no plea or declaration and the case was continued for further examination.
Solicitor John Boyle applied for his client to be released on bail ahead of a further appearance in court.
The motion was granted by the sheriff.
The Crown now has a year in which to bring the case back to court. A spokesman for Police Scotland previously confirmed that the man was reported in connection with an alleged contravention of the Dangerous Dogs Act 1991.
He said: “Police Scotland can confirm that a 65-year-old man has been reported to the procurator fiscal in relation to the dog incident in Fintry, Dundee, on December 1.”
The act enforces restrictions on the breeds of dogs that are deemed to present a danger to the public.
It also enforces bans on people having dogs bred for fighting, and carries powers around ensuring that certain dogs are kept under proper control by their owners.
