Community payback for woman who attacked PC

A WOMAN who shouted “rape me” at a police officer and launched a physical attack on another – kicking him on the shins – has been sentenced to a community payback order.

Michelle Burnage, 38, of Tweed Crescent, Dundee, admitted two offences dating from October 28 last year at Dundee Sheriff Court.

The court heard she had been drinking heavily and taking medication on the date in question.

Depute fiscal Charmaine Gilmartin told the court: “Around 11pm on the date in the complaint, police received a call about an incident in the Seagate in Dundee.

“Officers attended and found Burnage lying on the ground, shouting and swearing.” Ms Gilmartin went on: “Constable Kidd, named in charge two, spoke to Burnage, and she was aggressive and lashed out and kicked him on the shin.

“She continued to kick the officer on the shin and was subsequent­ly arrested.

“She was placed in the rear of a police vehicle.

“She continued to shout on the journey to police headquarte­rs on West Bell Street.”

The court was told Burnage made threatenin­g and offensive remarks to the officers in the vehicle during the journey to the station.

Burnage admitted a charge of behaving i n a threatenin­g or abusive manner.

Prosecutor­s said this was likely to cause fear or alarm, i n that she shouted, swore, made sexually-offensive remarks and acted aggressive­ly.

Burnage further admitted that on the same date, on Seagate, she assaulted Constable Scott Kidd, who was then engaged in the course of his employment, and repeatedly kicked him.

Burnage’s defence agent told the court she had not been in trouble with the law since 2000.

Her defence agent added that Burnage’s conduct was attributab­le to having drunk heavily on the day of the offences, and that she was taking antidepres­sant medication.

Sheriff John Rafferty sentenced Burnage to 100 hours of unpaid work for each offence, to run concurrent­ly, with the work to be carried out within four months.
