Duo charged over pub altercation
Two men have been sentenced after a drinker was attacked at a Motherwell pub.
Craig Livingstone hit Donald Mcindoe with a glass of beer and a bar stool.
The assault continued outside thewar Office in Milton Street where Mr Mcindoe ended up on the ground and was kicked by James Bissett.
Livingstone, 33, of Clydesdale Court, New Stevenston, was last month put under supervision for a year and ordered to pay the victim £750 in compensation. He must also do 200 hours of unpaid community work.
Livingstone admitted assaulting Mr Mcindoe to his severe injury on August 4 last year.
Mr Mcindoe had 22 staples put in head wounds. Jennifer Mclaren, prosecuting, told Hamilton Sheriff Court:“livingstone punched him twice on the head, picked up a glass of beer and threw this at his head. He then threw a bar stool at Mr Mcindoe’s head.”
Livingstone, whose brother runs the pub, said he was helping out on the night of the assault.
He claimed Mr Mcindoe was in a group who had brought in their own alcohol.
Words were exchanged and Livingstone, who had also been drinking, lashed out.
Bissett, 57, ofvulcan Street, Motherwell, appeared at the same court this week.
He admitted confronting Mr Mcindoe, struggling with him and kicking him repeatedly on the body to his injury.
Eddie Robertson, defending, said pub regular Bissett had won a raffle that night and had“no intention of causing hassle”.
But, foolishly, he became involved as Livingstone continued the assault on Mr Mcindoe outside.
The kicks he delivered caused bruising to the victim’s shoulder. Sheriff Moira Mackenzie fined Bissett £300, telling him:“it’s clear your involvement was lesser than that of your co-accused.”
