refer this matter back to committee for proper consideration of the drainage and flood risk matters, this places both the council and the applicant [Wakefield-based Miller Homes] at risk of an unsound decision being issued, which could lead to a legal challenge.”

In a separate letter to councillors, Veronica Woollin and Cheryl Tyler, who chair GLAAG and Save Mirfield, say the committee was misled by incorrect information “supplied and perpetuated” by planning officers and Miller Homes.

They say councillors who made the decision to approve the housing scheme were not in possession of the full facts and that the determination was “unsound and unsafe”.

They add: “Councillors, we have written to you in good faith, trusting you will take the opportunity to hold the applicant and the planning department accountable for the lack of critical information not being presented to you at the meeting in December 2019.

“Do not allow yourselves to become scapegoats for a decision which omitted to set the overriding priority of safety of people and homes within our community.

“If the planning department is so sure that what you were not told is unimportant, why will they not take it back to committee so that you can judge for yourselves?”

A spokesperson for Kirklees Council said: “The council has received the correspondence referred to and the contents are currently being considered.”
