Three more years for an inmate who struck officer

HE SMASHED MUG OVER HIS HEAD

AN inmate who smashed a coffee mug over the head of a prison officer causing laceration­s to his face will spend three more years in prison.

James Shipley, who at the time was a prisoner at HMP Humber, became agitated when he discovered his cell door was left unlocked, leaving it open for anyone to walk in and take his stuff.

Prison officers noticed Shipley, with a ceramic mug in his hand, on the landing of the first floor on M wing despite the fact he was supposed to be working.

Only cleaners were meant to be on the landing at that time while other inmates worked, so Shipley was told to return to his cell.

“Why is my f****** door unlocked,” shouted Shipley from across the wing.

This alerted prison officers who explained to him that he needed to ask for his cell door to be locked ,which he had not done.

Shipley became argumentat­ive towards prison staff and shouted: “It’s your job. You should do it automatica­lly, but you lot can’t do your f****** job.”

Shipley eventually returned to his cell but came back onto the landing, still holding on to the mug, where a further altercatio­n with prison staff ensued.

Three officers approached Shipley to ensure he returned to his cell when he shouted,” “What are you going to f****** do?”

One officer approached the inmate where he said: “Bang up.”

Shipley stepped forward and used both hands to push the officer, causing him to fall back against another cell door.

A female officer also aiming to get Shipley back in his cell pressed the alarm on her radio as the staff member tried to restrain Shipley.

“Come on then, what are you going to do?” shouted Shipley.

The prison officer he had pushed tried to grab the inmate’s hands, but was not able to do so and then made an attempt to kick the back of Shipley’s legs to bring him to the ground.

“But then without warning the defendant used his right hand holding the mug to hit the prison officer on the left side of his face,” said prosecutin­g barrister Nadim Bashir in Hull Crown Court.

“The prison officer looked up and saw the mug had smashed and what was left in Shipley’s hand was the handle and sharp edges of the mug.”

Shipley then hit the female prison officer with his fist before striking the other staff member with the smashed mug for a second time.

The officer struck by mug was taken to Hull Royal Infirmary after suffering up to 11 centimetre­s of laceration­s to the left side of his face, ear and neck.

Prison officers armed with riot gear then extracted Shipley from his cell and took him to the segregatio­n unit.

Shipley, who was jailed for aggravated burglary, was sentenced to a further three years for unlawful wounding and assault on an emergency worker.
