Jury clears pensioner of raping woman

A pensioner has been cleared of raping a woman after going to her home for tea and cake.

The woman, in her late 60s, made it plain she did not want to have sex with Colin Ash, a jury at Maidstone Crown Court was told.

Prosecutor Daniel Stephenson said Ash tried to fondle the victim after she made him a cup of tea.

Mr Stephenson added: “She said: ‘No, that’s not happening.’ The next thing she knew his trousers were off and on the floor.”

Married Ash, 74, of Maidstone Road, Paddock Wood, put his leg over her and committed the sexual offence, the jury heard.

“She said she was very clear she did not want sexual contact with him at all,” said Mr Stephenson.

“She said it more than once. She feared he would become violent.

Denying rape, Ash, who is dyslexic and hard of hearing, admitted there was sexual contact but claimed she “most definitely” consented.

“She asked me if I wanted a cup of tea and a piece of cake,” he said.

They had a kiss and a cuddle, he continued, and he got worked up. A woman desperate for help after being beaten unconsciou­s by her husband tried to flag down motorists in Maidstone, but none stopped to help.

Thug Aurimas Dzervus battered his 26-year-old wife while at Mote Park– even continuing the brutal assault after knocking her out cold.

Dzervus, 22, who had previously been arrested in Lithuania for domestic violence, repeatedly punched and kicked his victim during July’s late-night attack.
