WOMAN RAPED BY GUEST AT HER OWN HOUSE PARTY

SLEEPING VICTIM WOKE TO FIND NAKED MAN IN HER BED

A WOMAN was pinned down and raped in her own bed by a party guest who had stayed behind after everyone else had left, writes Suzy Gibson.

The victim’s partner was fast asleep downstairs and did not hear her screams for help, a court heard.

A court heard that the attack only ended when her young son woke up and went to his mother’s bedroom door.

Marius Jackeviciu­s, 30, pleaded guilty to raping and sexually assaulting the woman in her home.

Leicester Crown Court heard that the woman had only known the defendant a few months when he attended a small party at her home and became “very drunk”.

Prosecutor Anwar Nashashibi said: “The last guests left by about 1am, but the defendant remained downstairs, drinking with the victim’s boyfriend.

“Eventually the boyfriend fell asleep on the sofa. Jackeviciu­s then went upstairs, took his clothes off and got into bed with the victim, who was sleeping. She awoke to find a naked man in bed behind her.”

A SLEEPING woman was pinned down and subjected to a horrific rape in her own bed by a party guest.

The victim’s partner was fast asleep downstairs and did not hear her screams for help, a court heard.

The attack only ended when her young son woke up and went to his mother’s bedroom door.

Marius Jackeviciu­s, 30, pleaded guilty to raping and sexually assaulting the victim in her Leicester home in the early hours of Saturday, September 9, 2017.

Anwar Nashashibi, prosecutin­g at Leicester Crown Court, said the woman had only known the defendant a few months when he attended a small party at her home and became “very drunk”.

The barrister said: “The last guests left by about 1am, but the defendant remained downstairs, drinking with the victim’s boyfriend.”

The woman put her son, who is of school age, to bed and then got into her own bed in her underwear.

The prosecutor said: “Eventually the complainan­t’s boyfriend fell asleep on the sofa. Jackeviciu­s went upstairs, took his clothes off and got into bed with the victim who was sleeping.

“She awoke to find a naked man in bed behind her and, realising it wasn’t her boyfriend, screamed at him to ‘get out.’ He ignored her, holding her hands together with one hand.”

She continued to struggle and resist as he sexually assaulted her, before forcing himself upon her.

Mr Nashashibi said: “The defendant was disturbed by the victim’s son, who may or may not have seen anything. He jumped out of bed and started dressing. The victim wrapped herself in a cover and ran downstairs where she tried to awaken her drunken partner, screaming at him to wake up and slapping him. He awoke to find her screaming ‘help me’.”

Jackeviciu­s came downstairs and denied any wrongdoing when confronted by the boyfriend, who punched him.

The pair fought in the street before the defendant made off, at about 6.30am.

The victim was traumatise­d and, when a female friend called round two hours later, she “collapsed to the floor, saying she’d been raped” and the police were called, said the prosecutor.

He added: “It’s had a severe effect upon her life, her emotions and mental state, her relationsh­ip, her social life and work.

“She blamed herself and her partner, she felt ashamed, humiliated and frightened.”

Jackeviciu­s was arrested on September 11, 2017, and although he accepted getting into the victim’s bed, he denied anything sexual happened.

He was released pending further inquiries and rearrested two years later having been found sleeping rough at Manchester Airport.

In the meantime, scientists had detected the defendant’s DNA on the victim’s underwear.

Sentencing, Judge Timothy Spencer QC said: “This couple invited you into their home. They showed you kindness and hospitalit­y and this is how you repaid it - it’s outrageous and deeply shaming. “The complainan­t’s partner fell asleep and you saw that as an opportunit­y to force yourself upon her while she was asleep in her own bed - where she was entitled to feel safe and secure.”

Judge Spencer said: “You pinned her to her own bed by holding her hands together above her head and held her down.

“She was struggling and screaming, but none of that deterred you. “It only came to an end because you were disturbed when her son woke up and made his presence known to his mother. It’s had a very damaging effect upon her and the rest of the family.”

The judge accepted the defendant was of previous good character and had fragile mental health.

Katya Saudek, mitigating, said: “He has paranoid schizophre­nia and was hearing voices when rearrested last year.”

At one stage he was believed to be unfit to plead, but the court heard his mental health had improved with medication.

Miss Saudek said: “He wants to say ‘sorry’. It perhaps rings hollow to the victim and her partner, but it’s a considerab­le step for someone who has no memory of the event, but he accepts the evidence.”

Miss Saudek said the delay in bringing the case to court was not of the defendant’s making.

She said that, thankfully, the victim’s child did not actually witness his mother being raped.

Miss Saudek said: “He’s legally in this country and was in full-time employment until he became mentally unwell.

“It was out of character and he’s clearly remorseful by his guilty plea.

“Until this matter he led a lawabiding life.”

Jackeviciu­s, of no fixed address, but formerly of Leicester, was jailed for four years.
