Man threatened his neighbour over loud music row

AMAN who threatened his neighbour after a row about loud music was pepper sprayed by officers before kicking through the window of a police car, a court has heard.

Jonathan Lee Stott, 29, of Church Street, Bollington, lived in shared accommodat­ion with the affected man and although they had previously been friends, there was animosity between them, Stockport Magistrate­s’ Court heard.

Prosecutor Robin Lynch told the court that the offences took place in the early hours of October 13 this year at the property on London Road, Macclesfie­ld.

He said: “The complainan­t heard banging and kicking at his door and threats were issued by the defendant. This went on for some time.

“The police attended and he seemed to calm down.

“The officers were going to leave it at that but when he returned inside he carried on in the same vein, threatenin­g to ‘knock people out’.

“After his arrest he was on his back in a police vehicle when he kicked out at a side window, causing it to smash.”

Stott had earlier pleaded guilty a count of using threatenin­g, abusive or insulting words or behaviour and criminal damage,

The court heard he had 16 previous conviction­s for 38 offences.

Defending, Peter Casson said the issue had arisen as Stott believed his neighbour in the shared accommodat­ion would play music too loud.

He said: “The police had pepper sprayed him as they arrested him and when he was put in the police vehicle the windows were up, cutting off any fresh air

“He he out to get some fresh air. He couldn’t breathe and felt he was losing consciousn­ess.”

A probation report on

Stott said ‘he had previously been good friends with the victim’ and in interview he had admitted threatenin­g to beat him up on the night in question.

The bench sentenced Stott to a 12-month community order with 30 rehabilita­tion days and ordered him to pay £250 compensati­on to the police for the smashed window.
