As someone who has been a social worker, mother, wife and divorcee I have been around the block a few times. I’m humbled to answer your questions and feel that if a problem can be shared it can be halved – at the very least.

It’s good to be aware that a new marriage annuls any previous will, so you do have to make new wills – both of you. These are separate legal documents for each of you. A solicitor or respected relative can guide you in this. But first, it’s important to earmark the right time to discuss this with your husband. Pick a time when you are both feeling amicable and close. He may well have never thought about it, but it must be done.

If you can agree to plan to share it all out, then that is brilliant, and this is what often happens. Then you both can be issued with new wills that are in agreement. However, if you cannot agree – and I hope this is not the case – it will be necessary to get legal guidance. I know this sounds unpleasant, but dying with no will often leads to lengthy disputes and avoidable stress. Bite the bullet now – and good luck!
