Lout who spat on his disabled fiancée is spared jail sentence

Sheriff is told that victim is cared for by brute

A thug spat in his disabled fiancée’s face but was spared jail because she needs a carer.

Daniel Docherty, 27, admitted attacking Amy Harvey during a row at their flat.

But he was handed unpaid work with extra time to complete the hours after it was discovered the yob looks after the mum full-time.

Sheriff Colin Pettigrew told him the assault was “frankly disgusting” but insisted a prison stretch or fine would leave Ms Harvey struggling, or with no help.

He said: “Your partner should not have to suffer because of what you did to her.

“If I impose a fine, it is going to impact on the household budget.”

Ms Harvey suffers from a degenerati­ve condition which leaves her with debilitati­ng back pain.

She needs to take regular medication to cope with the problem and relies on Docherty for assistance around the home.

Docherty was handed 60 hours of unpaid work after he claimed he could only leave Ms Harvey for short periods.

He said: “I can leave her a few hours every day.”

The yob earlier pled guilty to gobbing on his partner at their flat during an appearance at Paisley Sheriff Court.

Docherty represente­d himself at yesterday’s sentencing for the ordeal in Seedhill Road last November 14.

He revealed he was the main care giver for Ms Harvey and the pair remain together.

Sheriff Pettigrew gave him “longer than usual” to complete the community work to allow him to assist his victim.

It is believed the pair got engaged three years ago and live together in nearby Claud Road.

Docherty was slapped with a £300 fine, but this was commuted down to 60 hours of unpaid work to be completed in five months.
