Teen put on Sex Offenders’ Register

A former fairground worker has been put on the Sex Offenders’ Register – despite claims his 15-year-old victim lied in court.

Kyle Cummings, 22, charmed the youngster back to his home after meeting her while working on a merry-go-round.

He was found guilty of sleeping with the schoolgirl after a trial at Paisley Sheriff Court.

Cummings was yesterday put on the list for nine months and told to carry out community service.

But defence lawyer Gordon Ritchie insisted his client was innocent and claimed the victim had made Facebook posts claiming she had not told the truth during evidence.

He said:“There have been events taking place after the trial.

“The complainer or somebody purporting to be her has posted a comment saying,‘Haha, I lied, yet you were still proven f*****g guilty. Enjoy jail.’

“On the face of it, this would appear to be an admission by the complainer of perjury.

“This whole trial hinged on the complainer’s credibilit­y and reliabilit­y.”

Cummings’interest in the schoolgirl – who cannot be named for legal reasons – ended after teachers found out and told her mum.

He was found guilty of having sex with the teenager after sending her“flirty”texts at his home in Cartside Avenue, Johnstone.

The girl was led to a bedroom with a mattress on the floor last October 27.

He was sacked from his job working on fairground rides, including ones in Glasgow’s St Enoch’s Square, after details of his conviction were published on the internet.

Sheriff Susan Sinclair maintained she could only sentence Cummings on his trial conviction.

She explained:“What might have happened online past conviction is not a matter for me but the relevant authoritie­s.

“The complainer was two months short of her 16th birthday and, while a willing participan­t, the law is designed to protect girls from themselves.

“You are old enough and responsibl­e enough to make your own decisions.”

Cummings was placed under supervisio­n for nine months and told to carry out 200 hours of unpaid work over the period.
