This week, McNicholl appeared in court from custody, where he pleaded guilty to charges of being found in the curtilage of a property at Corsebar Road where it could be inferred his intention was to commit theft on January 22.

He also pleaded guilty to assaulting a police officer by kicking her on the body.

The yob admitted he committed the offences while out on bail.

Defence agent Michael McKeown said: “His position is the offence took place during the course of a struggle and was not intended.

“He has a significan­t record of previous conviction­s, but I cannot see any previous offence involving the police.

“He said his benefits were stopped, he was destitute and he was looking for a shed.”

However, Sheriff Tom McCartney said the only suitable punishment for the crook was a prison sentence.

He said:“Considerin­g all that has been said, only a prison sentence is appropriat­e.”

He handed McNicholl 100 days behind bars, reduced from 150 days, taking into account his early plea of guilty.
