Husband who flouted ban will be deported

A husband who flouted a ban on contacting his wife is being deported.

Repeat offender Marian Stan, 42, was ordered to keep away from Geanina after being released on bail.

But he was spotted driving with her and was arrested – adding to his serious criminal record.

Stan will now be kicked out of the country after admitting the offence at Paisley Sheriff Court.

Prosecutor Frank Clarke told how police caught up with the pair.

He said: “The vehicle he was driving was a transit van and was stopped by officers.

“Present within the car was the accused and a female.

“Checks were carried out and they confirmed the female to be Geanina Stan and that he was subject to special bail conditions not to approach or attempt to approach or contact her.”

Stan was granted bail for a separate matter on August 17.

He was told to keep away from his wife while the case was ongoing.

But he was seen with her just weeks later in Kashmir Avenue, Linwood.

Stan has been held pending deportatio­n after he was picked-up.

He is being removed from the UK due to fears over his offending record.

The matter for which he was bailed has been dropped following plans to take him from the UK.

Defence lawyer Gordon Nicol said: “It’s accepted the reason the couple were together is that Ms Stan contacted him to tell him that she had spoke to police and bail conditions had been removed.

“Unfortunat­ely, he took no steps to check with his own lawyer to see if there was any truth to that. “He believed his wife.” Sheriff Colin Pettigrew admonished him, pending his removal.

He said: “There was an obligation for you to obey the bail condition.

“I understand why you would have believed your wife.

“It would have been far more sensible to check with your lawyer.”

Stan, of Morven Drive, Linwood, is expected to leave the country within months.
