Man let himself into ex’s flat for shower, despite court order ban

He crept in when she was out

A man banned from contacting his girlfriend landed in hot water after he let himself into her flat for a shower.

David Roxburgh, 57, was forbidden from approachin­g Jan McAlister or entering her home after he was bailed.

He waited until she left to visit grandchild­ren then crept inside, later claiming he had no cash for electricit­y or hot water.

During a hearing at Paisley Sheriff Court, Roxburgh admitted breaching the order.

Defence lawyer Nadine Dormer claimed delays in receiving benefits spurred him to flout the ban.

She said: “He has a paralysed arm. He previously worked as a roofer and fell off a roof and broke his back.

“He walks with a stick and is partially blind.

“He had not received his Disability Living Allowance.

“He could not afford electricit­y for his own property and he was in desperate need of a shower.”

Roxburgh had been told to keep away from Ms McAlister’s address as part of his release during a pending court case.

He was discovered after he answered the door when police were carrying out routine checks.

He spent two nights in a cell after officers visited the flat in Paisley’s Brown Street around 7.30pm on Saturday.

The court heard he had used a key given to him to gain entry.

Roxburgh claimed his gas and boiler were out because he was unable to pay his bill.

Prosecutor Claire Rowan told how he waited until he knew his partner would be gone.

She added: “They have been in a relationsh­ip for 19 years.

“He does have his own address but he spends the majority of his time at his partner’s flat.

“He knows she looks after her grandchild­ren on Saturday nights and would not be in.

“He let himself in with the key he has as he knew she would be out.”

The solicitor appealed for her client to be bailed again over the offence.

Sheriff Frances McCartney called for reports and remanded him in custody.

Roxburgh, of Douglas Street, Paisley, will learn his fate next month.
