Vile creep filmed sex act on mobile phone

Sleazy party-goer then went home and battered his wife

A sleazy oil worker who carried out a sex act with a sleeping woman’s head on his lap, has been shown mercy by a sheriff.

Offshore worker Allan Fagan, 42, recorded the X-rated footage on his mobile phone at a house party while a woman lay snoozing.

He then staggered home after the victim fled and then attacked his wife during a drunken rampage after she found out about his infidelity.

Paisley Sheriff Court heard Fagan, of Erskine, admitted carrying out the sexual act which took place during a bash at Brierie Hill Court, Houston, last month.

He also admitted charges of assaulting his wife by seizing hold of her, pushing her to the ground, and behaving in a threatenin­g and abusive manner likely to cause a reasonable person to suffer fear and alarm by smashing a door, punching a wall and forcing his wife to lock herself in the bathroom.

Defence agent Gordon Williams said the offshore worker had been left “mortified” at his drunken antics and appealed to the court to spare him a jail sentence.

He added that Fagan had already received a “warning” from his bosses over the scandal and was hoping to keep his job.

He said: “He was mortified at his conduct, following his arrest. He is hoping to rebuild his life and wants to retain his job.

“This has been a very unhappy episode.

“He took six weeks unpaid leave from his job offshore and has already received a warning from his employers.

“He hasn’t seen his wife since the incident and has been residing with his mother.

“Word received from his mother is that his wife is also keen to rebuild their marriage.”

The lawyer added that Fagan had pleaded guilty to the offence at the earliest opportunit­y, had no record of previous conviction­s, and had demonstrat­ed a very good work record.

Sheriff David Pender agreed with the lawyer after studying background reports and listening to the defence submission­s.

He said: “Had it not been for you taking far too much drink, then the incident would not have taken place.

“Registrati­on is punishment enough. I’m not going to impose unpaid work.”

He placed Fagan on the Sex Offenders’ Register for nine months because “of the nature of the offence”.

He was also fined £400 for the other offences.
