Drunk brute lost the plot with mum and boy, 11, for waking him

A tanked- up yob attacked a mum and assaulted an 11-yearold schoolboy after he was woken from a drunken stupor.

Kieran McGinley, 29, had been sleeping off a drinking session on a couch when he was woken by the noise of people getting ready in the morning.

Paisley Sheriff Court heard McGinley first slapped a woman, who complained about him hanging around in a dishevelle­d state, in the face.

The yob then assaulted a youngster, who had intervened in the row, by shoving him and causing him to strike his head off a wall.

Procurator Fiscal Depute Maureen McGovern said: “On the evening of March 16, the accused arranged to stay over until the following morning.

“The next morning it was noted that he was no longer welcome and was clearly under the influence.

“He was observed still sleeping on a coach by the complainer.

“The complainer did not want to leave the accused in the house, especially while under the influence of either drink or drugs.

“She attempted to wake him up. He became immediatel­y volatile and demanded a cigarette.

“She told him she wanted him to leave.

“He got to his feet and ‘got in her face.’

“He slapped the complainer with his right hand on the left side of her cheek.”

The court heard the attack was overhead by the schoolboy, who asked why McGinley had done this.

The prosecutor added: “The child then asked the accused to leave the house.

“The accused told the boy to ‘shut up,’ and proceeded to push him, causing his head to strike off the wall.”

McGinley of Lochfield Road, in the south end of the town, pleaded guilty to assaulting the schoolboy by pushing him on the body causing him to strike his head off a wall to his injury.

He also admitted assaulting the woman by striking her on the head with his hand.

Defence agent Paul Lynch said: “The accused has pleaded guilty to this offence and he would consent to any order your ladyship feels is appropriat­e.

“He suffers from ADHD and autism and has tried to address this with alcohol.

“He has offered his sincerest apologies to the woman and the child concerned.”

The lawyer added McGinley, who appeared at court supported by his brother, had expressed remorse over the incident.

Sheriff Lyndsey Kooner, who had called for background reports prior to handing McGinley his punishment, voiced concern over his behaviour.

She said: “Clearly you have a lot of work to do to repair the damage you did that evening.”

She placed him under supervisio­n of the local authority for 12 months and handed him 130 hours of unpaid work to be completed within eight months.
