Lout banned from seeing girlfriend is caught out for 3rd time

A dozy boyfriend made such a racket partying with his girlfriend that he was rumbled for flouting bail orders barring him from seeing her.

John Dalziel, 46, was caught for the third time in the company of Kerry McCool at a property in Paisley’s Whitesbrid­ge Avenue, despite a court order preventing him from approachin­g or contacting her.

The town’s sheriff court heard Dalziel had broken his bail on June 22 and July 1, before racking up his latest brush with the law on August 24.

Procurator fiscal depute Susan Barr told the court: “The accused and Ms McCool had been in a relationsh­ip for two years, but do not live together and they have no children.

“A neighbour overheard a commotion coming from the property at Whitesbrid­ge Avenue and contacted police.

“Police arrived at the property and discovered that Ms McCool was within the accused’s address.

“He allowed them entry and he was told he was in breach of his bail conditions. He was arrested and made no reply.

“Ms McCool refused to engage with police.”

The court heard Dalziel had recently been warned by a sheriff after pleading guilty to bail offences preventing him from seeing his girlfriend.

Defence agent Waqqas Ashraf said: “He fully accepts responsibi­lity for the offences.

“Only a month before he was admonished in court for two identical charges.

“He is lucky to have his liberty intact and he now recognises that bail conditions are set by the court and they are not set by him or his partner.”

The lawyer added that his client is keen to reconcile with his partner and wants her back in his life, once matters with the court are settled.

Sheriff Tom McCartney tore a strip off Dalziel, telling him: “I am amazed the same offences were committed for which he was admomished.

“It is not for him to pick and choose.” Dalziel was handed 40 hours unpaid work and warned to heed conditions of his release or he would be locked up.

He will appear at court in November on other matters.
