Drunk who lashed out in rage given court order

A sozzled dad who pushed his partner’s face into a couch before punching her and calling her a‘fatty’ has been given a chance to show he’s changed his ways.

Christophe­r Gemmell, of Arran Drive, Johnstone, was back in the dock at Paisley Sheriff Court today after previously admitting to slinging offensive and derogatory remarks towards Sharmane Webster and assaulting her by pushing her face into the couch in their family home and punching her.

The court previously heard how the 33-year-old returned to the home in Arran Drive drunk on September 11 after storming out during a row earlier that day.

It was once back in the house later that night that Gemmell lashed out and shouted vile abuse at Ms Webster.

Procurator fiscal depute Caitlin O’Hare previously told the court: “Around 7pm that night, Ms Webster was in the living room.

“Gemmell let himself in via the back door and made his way from the kitchen to the living room where he started to shout and swear.

“He was calling her, ‘a fatty,’ ‘a cow,’ ‘a b***h,’ ‘a slut’ and ‘a slag’, telling her to ‘f**k off ’.

“Gemmell continued to act in an aggressive manner.

“Gemmell then lunged at Ms Webster, grabbing her by the hair and slamming her head into the side of the couch.

“Gemmell then got on top of Ms Webster and punched her right thigh.

“Ms Webster left the house and went into the garden where she contacted the police.

“The police attended and arrested Gemmell, taking him to Greenock police station where he was cautioned and charged.”

Gemmell’s solicitor Mr Lynch previously told the court that the dad accepted he acted in an “unacceptab­le way”.

During his appearance today, the court heard the couple were now back together, with Mr Lynch asking Sheriff Gillian Craig to avoid enforcing a Non-Harassment Order.

He added: “I would invite you to consider the recommenda­tion on the report which identifies a Community Payback Order with a supervisio­n requiremen­t which would not only benefit him but also the family unit.”

Addressing Gemmell in the dock, Sheriff Gillian Craig said: “In relation to this matter which is considered quite a poor set of events involving your partner.

“I note her submission that things are much better between you.

“I am prepared to accept that imposing a Non-Harassment Order is not necessary and I hope I am not wrong.”

Gemmell was placed on a Community Payback Order and was placed under supervisio­n for one year.

He was also instructed to carrying out 120 hours of unpaid work within a year.
