Jailfordrink-driving weeksafterbanends
Just weeks after getting his licence returned after a ban, a Perthshire man was caught driving while more than three times the booze limit.
The incident, which took place in broad daylight in Auchterarder High Street, led to 34-year-old Mark Findlay being jailed for four months at Perth Sheriff Court.
The accused, of Raven Grove, Auchterarder, was also disqualified for 40 months.
Sheriff Gillian Wade told him:“It seems to me you have no regard whatsoever for the authority of the court and you continue to offend.”
He admitted driving his car with 76 microgrammes of alcohol on his breath the legal limit is 22 - on February 4, 2018.
He had been banned for a year and fined £670 for a similar offence at the Perth court on January 5 last year.
Depute fiscal Bill Kermode said police were on routine patrol about 2.30pm that day when they were alerted by a member of the public that he had “clipped”the wing mirror of their vehicle.
“He seemed to have difficulty controlling the vehicle which was rolling slowly backwards,”explained the fiscal.
“On speaking to the accused, he smelled of alcohol and was required to provide a roadside breath specimen.”
Solicitor David Holmes said his client had been drinking and had then fallen asleep.
Imposing the lengthy ban, Sheriff Wade told Findlay:“This is your second drink/driving offence and you only just got your licence back.”
