Driver whofell outvanwas ‘clearlydru­nk’

A van driver screeched to a halt near the Queen’s Hotel in Perth and then almost“fell out of the vehicle” before shouting up angrily at his ex-wife’s flat.

A member of the public became alarmed at the erratic piece of driving and contacted the police as Michael Diver was“clearly drunk,” Perth Sheriff Court was told.

During the rant outside his ex-wife’s house in Cross Street, he shouted and swore and then threatened to“come back tomorrow and sort her out.”

Forty-three-year-old Diver, of South Street, Perth, then left but was later traced by police.

His behaviour led to him being jailed for a total of 10 months when he appeared for sentence.

He was also banned from driving for 14 months.

He admitted acting in an aggressive manner, shouting and swearing and making threats in Cross Street on March 19 this year.

He also drove while unfit through drink or drugs in both South Street and Cross Street the same day.

A third charge of being in possession of cannabis at South Street on April 20 was also admitted.

Solicitor David Holmes said:“He had become upset about what he had seen and heard about his former partner and her activities.”

Because of that he had taken too much alcohol but had driven only a relatively short distance.

Describing the accused’s behaviour as“sheer folly,”Mr Holmes said they were now divorced.

Because Diver wasn’t willing to accept the supervisio­n requiremen­ts proposed in a background report, Sheriff Gillian Wade said she had“no alternativ­e” but to impose a custodial sentence.
