Thug battered woman with bottle

- Court reporter

A Perth thug who viciously attacked a woman, hitting her on the head with a bottle and then stamping on her, knocking her unconscious, was jailed for two years when he appeared on indictment at the Sheriff Court.

Twenty-one-year-old David Declan Burke, of Wallace Court, Wallace Crescent, also had another three months added to that sentence for flouting a Community Payback Order.

He was found guilty after trial of assaulting Zoe Tully in Davie Park Place, Blairgowrie, on July 15 last year.

He repeatedly punched her on the head, rendering her unconscious and causing her to fall to the ground.

He then repeatedly kicked her on the body and repeatedly kicked and stamped on her head and struck her with the bottle, all to her severe injury and permanent impairment.

Burke had previously been ordered to carry out 135 hours of unpaid work - and banned for 32 months - after sparks and smoke were seen pouring from a silver Volkswagen Golf as it careered along several roads in Blairgowrie.

The vehicle narrowly missed a lorry before crashing through a garden wall and colliding with a lamp post in Balmoral Road.

The court was told that the car, driven by Burke, had earlier made gouge marks along one of the roads because the rear nearside wheel was damaged and it had only a“partial tyre remaining.”

The front nearside tyre was also completely devoid of tread and two of the wheel trims were damaged.

The accused, who was living in Davie Park Place, Blairgowrie, at that time, admitted driving dangerously in Ferguson Park Road and Balmoral Road on July 8 last year. He also had no insurance or licence for the vehicle. The community payback order was subsequently breached.
