Man flouted bail while with ex

A Perth businessman flouted a bail order banning him from contacting his ex-partner by being in her company at a city school.

The incident led to 37-year-old Nikhil Modi having a community payback order imposed - as an alternative to a fine - at Perth Sheriff Court.

The accused, whose address was given as Unit 7A, on the city’s Inveralmond Industrial Estate, had been granted bail at the Perth court on February 1, 2017, with a condition that he shouldn’t approach or get in touch with Laura Modi in any way.

But he failed to comply with that, without reasonable excuse, at Kinnoull School, Dundee Road, on August 29 this year.

Depute fiscal Robbie Brown said there had been a meeting at the school about 3.30pm that day, attended by the accused’s wife and the accused.

They had been speaking to staff and left“in each other’s company.”

Solicitor Paul Ralph said it was hoped the accused, who is self-employed, had learned his lesson.

Imposing the order, requiring Modi to complete 20 hours of unpaid work, Sheriff Lindsay Foulis told him:“I can’t ignore this.

“You were flying in the face of an order which the court put in place to protect your wife - and the interests of justice.”

He was given six months to complete the work which will be carried out consecutive to another community payback order imposed earlier.
