Vicious attack after being lured to park

A not guilty plea was accepted to a second charge of striking the window of a car with a bottle at the park - and smashing it.

Nairn pled guilty to an amended charge of punching the victim on the head, to his injury.

Depute fiscal Carol Whyte explained: “The first named accused used to be good friends with the complainer.

“About 9pm on August 11, [the victim] received a Snapchat message inviting him to go to the park for a drink.”

When he arrived there at 10.45pm, he was approached by Michalak and then punched and kicked on the body.

Ms Whyte continued: “Mr Fair fell to the ground and the first-named accused continued kicking and punching him.

“At one stage, the second-named accused punched Mr Fair and thereafter split the fight up.”

The victim remained on the ground until he was sure both accused had gone. Ms Whyte added: “He then asked a passerby to contact his grandparen­ts and the police were alerted.”

Mr Fair suffered bruising around his eyes and grazing to the left side of his temple.

Michelak sent the text message to Mr Fair’s partner at 12.03am.

Police later traced both accused and they made “admissions” in relation to the incident during subsequent interviews.

Sheriff O’Mahony asked if there was any suggestion the victim had lost consciousn­ess as a result of the assault.

The fiscal replied: “It doesn’t appear so.

“He certainly lay still for a couple of minutes until he knew both accused had left the area.

“From his statement, he was aware of what was happening to him.

“He did hear shouting: ‘That’s enough.’”

Solicitors Pauline Cullerton, for Michalak, and Mike Tavendale, for Nairn, will give their pleas in mitigation when the pair return for sentence next month.
