Persimmon could face £2000 fine
Perth and Kinross Council has said it is prepared to fine Persimmon Homes up to £2000 if it doesn’t start managing a construction site in Kinross properly.
The local authority has warned the developer its staff at Lathro Farm/ Meadows must start working to an agreed Construction Environmental Management Plan (CEMP) created two years ago.
Persimmon Homes had to pull together a massive 200 page document incorporating among other things a construction traffic management plan, a site waste management plan and an environmental management plan to meet a condition of its planning consent.
More specifically the document set out how the company proposed to keep surrounding roads clear of muck deposited by its vehicles, how surface and ground water runoff would be dealt with and how the company would control dust and noise coming from construction works.
But according to a breach of condition notice served on the company by PKC its staff have failed to adhere to the measures specified in the document.
And, creating uncertainty staff are working to a suitable CEMP, a spokesperson for the Scottish Environment Protection Agency (SEPA) has now said it made certain“recommendations for improvements”to a version it saw two years ago but then did not get to see any“further versions” before PKC approved one.
A SEPA spokesperson told the PA:“SEPA was consulted on May 25, 2017 on the CEMP and Register of Aspects and Impacts required by condition under the planning consent for this site.
“SEPA provided comments on the CEMP and Register of Aspects and Impacts on June 12, 2017 making recommendations for improvements.
“SEPA did not advise discharge of the relevant conditions. We have not received further versions of these documents.”
PKC had failed to respond to inquiries about SEPA’s statement by the time the PA went to press yesterday.
But a spokesperson for Persimmon Homes said: “We can confirm that approval from PKC of our CEMP has been received and in addition we are in receipt of a Construction Site Licence in compliance with recently introduced new legislation from SEPA.”
