Man threw TV from his top floor city flat Court hears how pedestrian­s were put in danger

A passer-by could have been killed after a Perth man first hurled a 22-inch television set rom the top floor of his city centre flat onto the busy street below.

And that was quickly followed by a Sky digital box and then a mixing desk, Perth Sheriff Court was told this week.

Several police officers raced to the scene and the public footpath was closed for safety reasons for four hours until 30-year-old Kevin Smart was arrested and taken to Perth Police HQ.

Depute fiscal Mairi Graham told Perth Sheriff Court the alarm was raised about 1am.

The road was “busy with revellers enjoying a night out,” she said.

In a separate incident four months earlier, he threatened to jump as he hung outside the window of his housing associatio­n property in Kinnoull Street.

At one point he stood on the window ledge and shouted at police: “My eight-year-old daughter is going to lose her father if you don’t get f***ing back.”

He eventually went inside, closing the window, but was uncooperat­ive.

During a third episode, which took place at his parents’ home, Smart struggled violently with his father and had to be restrained with an extension cable after he repeatedly lashed out with his legs.

The accused had a community payback order imposed this week in respect of the first two confrontat­ions.

He will be supervised for 18 months and will have to undergo alcohol and drug treatment.

A restrictio­n of liberty order was also imposed, banning him from being outwith his home between 7pm and 7am on weekdays for the next fourand-a-half months.

Smart admitted that on February 24, 2019, at his home, he shouted and swore, threw items against a door and threatened to jump from the third floor window.

He also pled guilty to culpably and recklessly throwing electronic items - and furniture - onto the street below, to the “danger of pedestrian­s and members of the public.”

The third charge of behaving in an aggressive manner towards his father David Smart at his home in Talisker Place, Perth, on October 13, 2019, was also admitted.

He will be sentenced on that later.

The fiscal said the June 29 events took place about 1am.

Police arrived five minutes later and saw the electronic items lying on the street below Smart’s flat.

Given their weight and the height they had been thrown from, officers were of the view that someone could have lost their life if they had been struck.

The accused was finally arrested at 4.35am.

Solicitor David Holmes said the first incident was “effectivel­y a cry for help” from his client who felt he needed mental health interventi­on after the break-up of a relationsh­ip.

On the later occasion, Smart had taken cocaine and alcohol and had “no memory” of what had happened.

“He needed to be restrained for his own good.”

Sheriff Gillian Wade ordered a review of the accused’s progress on the court orders for December 18.
