Sentence extended for pool cue attack

A Perth Prison inmate who attacked another prisoner with a pool cue, striking him on the head three times, had another five months added to his present sentence.

Perth Sheriff Court was told that there had been a “background of bullying” leading up to the violent incident which was captured on CCTV.

Thirty-year-old Josh McLean is currently serving a four-year stretch at the Edinburgh Road jail after he subjected his ex-partner to a series of frenzied attacks which left her “absolutely terrified.”

Defence solicitor Gary Foulis said his client’s earliest release date was to have been March 18, 2022, and he asked that the inevitable prison term be served at the same time as his present jail term.

But Sheriff William Wood said: “I can’t ignore that this took place in a prison setting.

“It was an act of considerab­le violence, notwithsta­nding there were no injuries reported.”

He ordered that the five months be consecutiv­e to the four years imposed last year.

McLean admitted assaulting Josh

Bray at Perth Prison on February 24, 2020, by repeatedly striking him on the head with the cue, to his injury.

Depute fiscal Michael Sweeney said there had been a “discussion” between the accused and the victim at the prison pool table about 5pm.

McLean walked away but then returned with the pool cue and struck the complainer on the head “around three times.”

Lawyer Mr Foulis said that the other prisoner had been attempting to take a £140 pair of trainers from the accused.

“He should have reported the incident to the authoritie­s.”

McLean, of Nithsdale Avenue, Dundee, was previously convicted of six charges on indictment following a jury trial.

He chased his former girlfriend around her own home, threatened her with a knife and pinned her to a bed, choked her and bit her finger.

Sheriff Alastair Carmichael, who imposed the original sentence, told McLean: “The incident at your partner’s house was a prolonged and vicious series of violence towards her, which she said she found absolutely terrifying.”

The accused also had a 10-year NonHarassm­ent Order imposed, designed to keep him away from his victim.
