Bottle attack on husband

A woman attacked her husband of 23 years with a bottle during an argument over her drinking.

Fifty-year-old Eileen Davidson struck Scott Davidson on the head, knocking him to the floor, after he found empty vodka bottles.

He then discovered another full bottle of vodka, which she tried to hide from him, Perth Sheriff Court was told.

Fortunatel­y he escaped with a small cut to the back of his head and did not need medical treatment, stated depute fiscal David Currie.

Davidson, previously of Balvaird Place in Perth and now Mercat Green, Kinrossie, was spared a jail sentence this week.

Instead, she had a community payback order imposed as a“direct alternativ­e”to custody.

She will have to attend the One-Stop Women’s Learning Service (OWLS) project for the next 12 months and take part in an alcohol treatment programme.

Sheriff Neil Bowie told her:“An assault with a bottle, of any descriptio­n, is clearly not a trivial matter.

“It’s fortunate your husband effectivel­y received a minor injury.”

But he warned her that if she did not co-operate she could be brought back to court where“all sentencing options”would be available.”

Davidson admitted the bottle assault which took place in the house at Mercat Green on October 28, 2020.

She also flouted a November 20, 2020, court bail order banning her from going to the Kinrossie property or approachin­g or contacting her husband in any way.

The court heard that she went to the house “without reasonable excuse”on February 19, 2021.

Mr Currie said that the argument started over the husband’s concerns for the accused’s use of alcohol.

Solicitor David Holmes said:“Both parties wish to be together and work through these difficulti­es.

“Her husband has been very supportive.” He acknowledg­ed that his client had a previous conviction from 2019.

He added:“That indicates there has been a problem of standing and indicates the need for profession­al advice.”

Passing sentence, Sheriff Bowie told Davidson:“Clearly your issues to date have been very much alcohol-related.”

The sheriff said he was obliged to consider a non-harassment order against Mrs Davidson but decided it was not appropriat­e in the circumstan­ces.
