I’m sorry but Andrew Dalton (August) is right to say; “I’m no expert in Scottish law” because as a former officer, I can assure you that he’s completely wrong about how the law in Scotland relates to police powers and the Police and Criminal Evidence Act (1984). His advice may hold good for riders in England and Wales, where he practises law, but the situation is very different north of the Border. Any rider asked to hand their helmet camera to a Scottish policeman would be well-advised to give it up without argument as, under Scottish law, you’ll find that the police are well within their rights to take it.
