Father and son convicted
A RUNCORN father and son received community orders for assault occasioning bodily harm (ABH) and affray.
Malcolm O’Hare, 51, and Jake O’Hare, 26, both of Penfolds, pleaded guilty to their respective offences in May.
O’Hare Sr admitted ABH while his son admitted affray in connection with an incident on Arndale in Beechwood on July 21, 2017.
Warrington Crown Court heard the father had initially been charged with Section 18 wounding and possession of an offensive weapon, and his son charged with ABH and criminal damage.
On Monday, May 21, they entered pleas to the ● lesser offences on the morning of what was due to be the start of their trial for the more serious, now scrapped, indictment.
The father pleaded guilty on the basis that he had assaulted the victim with punches and then kicked him on the ground after coming to the defence of his son.
The case was adjourned for pre-sentence reports and for prosecutors to assess whether to pursue allegations that the same two defendants made what John Oates, representing the Crown, claimed were ‘bloodcurdling’ threats to kill against members of their victim’s family.
However, the prosecution offered no further evidence.
They were sentenced for ABH and affray at Chester Crown Court last Wednesday, July 4.
Malcolm O’Hare received a four-month community order, 30 days rehabilitation activity requirement and 100 hours unpaid work.
He was also ordered to pay a victim surcharge of £85.
Jake O’Hare was given a two-year community order, 20 days rehabilitation activity requirement, and ordered to attend the Resolve programme.
He too was made to pay an £85 victim surcharge.
