Serial lout hurled racist tirade at cop

- BY OLIVER CLAY

A PROLIFIC lout from Runcorn has been sent down after lying in the road and hurling ‘nasty’ racist abuse at a police officer in breach of a court order.

Helena Robertson, 42, of Cunningdrive Drive, called a custody suite officer a ‘black n ***** German’ before spitting all over her cell in what a judge branded a ‘disgraceful’ episode.

Robertson was arrested after she turned aggressive on her probation officer Eleanor Davies who found her lying intoxicated in the road on Westfield Road at 5.40pm on January 15 with her ‘eyes scrunched up’, prosecutor Mandy Nepal told Chester Crown Court on Friday.

Despite Miss Davies being concerned for her wellbeing and checking her pulse to make sure she was all right, Robertson rose to her feet and ‘came at’ her fuming: “You’re my f***ing probation officer, I’ll f***ing have you.”

Robertson fled and police searched her usual haunts and found her on a bench on Church Street in the town centre.

Her mood was ‘erratic’ and she went from being calm to aggressive and abusive.

Cautioned and taken into custody, Robertson launched into a grim tirade.

Miss Nepal told the court: “She was cautioned at this point and escorted to the police car and she was verbally abusive.

“She said they were ‘all b***ards’. “In the holding cell the abuse became worse.

“She shouted that the officers ‘were f***ing nonces’.”

Robertson’s abuse continued and she called one officer a ‘paedophile’ and another a ‘f***ing black n ***** German’.

Earlier that afternoon, Robertson had called 999 at 4.51pm claiming that a man was pointing something through her window, prompting a fruitless police search of the area with the call ultimately deemed a hoax.

Lying in the road, abusing the emergency services, and nuisance 999 calls were all breaches of a Criminal Behaviour Order (CBO) slapped on Robertson on May 25 last year in a bid to curtail her prolific nuisance antics with a maximum penalty of five years in prison hanging over her for a breach.

Miss Nepal listed other breaches of the CBO including for lying in the road and told concerned members of the public she was ‘fine, she was just drunk’ ‘conviction 36’ when she been lying on a path and refusing to move on September 9 then was abusive to the police, and conviction 37 a week later after she had been verbally and racially abusive towards police officers and was sent down for 10 weeks.

Simon Christie, defending, argued mitigation for her guilty pleas, and said the cluster of CBO breaches on January 15 should not be regarded as ‘persistent’ as it was part of one spree.

He said Robertson had long-term problems with alcohol and her mental health, suffering both bipolar disorder and depression.

Judge Simon Berkson sentenced Robertson to 10 months in prison, passing consecutive terms for the two charges: breaching her CBO and racially aggravated abuse.

He said the court had to consider her mental health background when passing sentence, and he condemned her behaviour.

During his summing-up he said: “You rang 999, the emergency services, a line dedicated for when there’s a real emergency, to describe an emergency which was simply to get them to come to your address.

“There was nothing wrong so they left.

“That sadly wasn’t the end of the matter so you did something you have done before.

“You lay across the road, close to where you thought your probation officer Miss Davies would be and she came across you.

“There was nothing wrong with you but sadly she thought there was something wrong with you and she would have been worried about you.

“That led you to be aggressive to her: ‘You’re my probation officer, I’ll have you’, going towards her, frightening her. You were rightly arrested, on Church Street in Runcorn, you were clearly drunk.”

He added: “Thereafter you were taken to the police station, you committed another nasty offence, you called the officer, PC Aston, a black n ***** German and spat all over your cell.

“This was disgraceful behaviour.”
