How system deals with asylum bids

-

Where does an asylum seeker have to go in order to make a claim?

ASYLUM claims should be made to an immigration officer as soon as someone arrives in the UK. If not, they may be denied accommodation and welfare support. The Home Office says an application will usually be decided within six months but this can take longer.

Once they have made authorities aware of their intention to seek asylum, they are given somewhere to live if they need it. This could be in a flat, house, hostel or bed and breakfast.

Who is responsible for providing that housing?

HOME Office asylum accommodation providers, in consultation with local authorities, are responsible for identifying suitable temporary hotel accommodation during the coronavirus pandemic.

Are those seeking asylum entitled to any financial assistance?

They are entitled to £37.7 for each person in a household. This is to help pay for things like food, clothing and toiletries.

The allowance is loaded onto a debit card each week and can be used to get cash at an ATM.

Can they work in the UK while their application is being considered?

THOSE who claim asylum are not normally allowed to work while their claim is being considered. However, the Home Office may grant permission to work to those whose claim has been outstanding for more than 12 months, although they are restricted in what jobs they can apply for. Permission to work ends if their claim is refused and appeals are exhausted.

What happens if someone qualifies for asylum?

THEY and their dependants may be given permission to stay in the UK for five years. This is known as ‘leave to remain’. After five years, they can apply to settle in the UK.

What happens if someone’s application for asylum is denied?

PEOPLE may also get permission to stay for humanitarian reasons if they do not qualify for asylum. This means they need to stay in the UK for their protection.

They and their dependants may be given permission to stay for five years. This is known as ‘leave to enter’ or ‘leave to remain’. After five years, they can apply to settle in the UK.

If it is decided that someone does not qualify for asylum and there is no other reason for them to stay, they will be asked to leave. They may appeal this decision but if this is unsuccessful they must leave. They can arrange this themselves or be detained at an immigration removal centre and then removed from the UK.

What happens if an application to extend leave to remain isn’t made in time?

IF a further leave application is made out-of-time then a person will lose the right to work from the date the leave expires. If the claimant has not made an application for further leave, or if the application was lodged after leave expired, caseworkers should refuse permission to work unless certain conditions are met.

Would they be sent to a detention centre?

REMOVAL centres are used in cases where people have no legal right to be in the UK but have refused to leave voluntarily.
