Near-fatal curry lands takeaway owner in court
A WOMAN with a nut allergy almost died after eating a curry from a Southport takeaway containing nut protein.
Lal Miah, the owner of Nasib Tandoori in Kew Road, Birkdale, appeared at South Sefton Magistrates’ court on Tuesday.
He pleaded guilty to the offence, under the Food Safety Act 1990.
The unnamed woman went into anaphylactic shock on March 21 after eating one forkful of the lamb bhuna with pilau rice, which Miah had assured her was completely nut-free.
She was then rushed to Southport and Formby District General Hospital.
Miah also pleaded guilty to a number of hygiene issues including failing to keep the equipment which comes into contact with food clean and disinfected, and surfaces left covered in grease.
Miah spoke only to confirm his name, address and date of birth and to enter pleas. He will be sentenced at South Sefton Magistrates’ Court on May 16.
A Sefton Council spokesperson, said: “We are pleased with the outcome of this case as it helps to highlight the impor- tance of the new food allergy laws.
“The conditions found by the environmental health practitioners investigating the complaint demonstrated a disregard for the basic standards of cleanliness.
“Sefton Council will continue to take strong enforcement action when public health is put at risk by negligent food businesses.”
