Husband facing prison after Lord St attack on wife

Judge Andrew Menary, QC, said he agreed and after confirming with Christophe­r Stables, defending, that Cushing accepted the prosecutio­n case in full, directed that the second charge should lie on the file.

Mr Stables requested an adjournmen­t for a pre-sentence report to provide the court with more informatio­n about his client.

He said: “The defendant is 30 years of age and he has very little by way of previous involvemen­t with the courts two matters before the magistrate­s in March 2018 and November 2019, both for excess alcohol and the latter including a small amount of production of cannabis.

“Never before has he been before the crown court, no history of violence, never before has he faced custody. Clearly he faces a very substantia­l sentence in this case.”

Judge Menary agreed and said the Probation Service would need to consider in particular “the alleged background to this matter”, “whether the defendant is said now to be a risk” and “the question of dangerousn­ess”.

If Cushing is found to be dangerous, he will receive an extended sentence, of which he will spend at least two thirds, rather than half of the sentence, behind bars.

The Honorary Recorder of Liverpool adjourned the case for sentencing on December 7 and said Cushing would be remanded in custody until that date.

Judge Menary told Cushing: “You need to understand that it is inevitable for this offence on count one that you will receive a prison sentence and the purpose of requiring a report is to consider the question of the potential risk you pose in the future.

“The fact that I am adjourning for a report should not be taken by anyone as any indication of sentence.

“All matters will be considered by the court on the next occasion.”
