Man jailed for hash stash

- Court reporter

A Stirling man was jailed for 14 months after police found around £3,500 worth of cannabis and cocaine in his home.

John William McMinn, 33, of Strathmore Drive, admitted being concerned in the supply of cannabis between October 1 and November 5, 2015.

He also pleaded guilty to possession of a cocaine with intent to supply between October 13 and November 5, 2015.

The court heard that police carrying out a search warrant at the address discovered cannabis valued at £1,500, as well as 48 grams of cocaine worth almost £2,000. Defence solicitor Virgil Crawford said McMinn was a cannabis user and sometimes provided the drug to his friends but for no charge.

He said: “He would generally buy large amounts for his own use, and expected the cannabis to last him to well beyond Christmas, even allowing for giving some away to his friends.

“It was purely a social supply, with no financial gain to him.”

He said that the cocaine had been brought to McMinn’s house by friends - who had left it there after he objected to taking a Class A drug on a night out. Mr Crawford added: “He refused to go out with them if they were taking cocaine, so they agreed to leave it at his house and pick it up later.

“The cocaine didn’t belong to him.

“While he has his own views in relation to cannabis, he doesn’t use any Class A drug himself.”

However, Sheriff William Gilchrist said: “In the case of the cannabis, you were supplying it to others.

“And as far as the cocaine was concerned, you were holding it for others, with the intention to supply.

“You are an adult. You should have known better.”

He sentenced him to seven months for each drug charge, to run consecutively.
