Women at odds over unpatrioti­c remarks

An apology was accepted in a defamation action involving women from Balfron, the Observer reported.

The action at the Outer House of the Court of Session in Edinburgh was brought by Misses Catherine McLannahan Birrell, Elisabella Margherita Birrell and Ellen Machado Birrell, all of Beech Cottage, Dunibert, Balfron, against Miss Marie Cooper, Ballindall­och, Balfron.

Counsel for the Misses Birrell alleged that Miss Cooper had made statements reflecting upon his clients’ patriotism and accused them of allowing lights to be shown on nights when Zeppelin raids were anticipate­d.

The Birrells were anxious for their good character to be vindicated and did not seek monetary damages.

Lord Ormidale, the judge, was told that Miss Cooper had now issued an apology which had been accepted.

It read: “The defender, without admitting the uttering of the slanders against the pursuers with which they charge her, being unconsciou­s of having used the expression­s complained of, at the same time unreserved­ly retracts and withdraws any statements she may have made reflecting or tending to reflect on the nationalit­y or patriotism of the pursuers, as there were no grounds there for, and expresses her regret for any such occurrence­s.”

Because of fear of air raids, regulation­s were introduced compelling residents and business owners to ensure all light from their premises was properly shaded. Those who flouted the rules were charged and brought before the court.
