Kids abuse pics man is back in dock over breach

A Killearn man who was convicted of possessing pornograph­ic images of children but failed to comply with court requiremen­ts has been brought back before a sheriff.

Craig Burke, 38, from Wellgreen, Killearn, appeared at Stirling Sheriff Court on Wednesday (September 20) after he was issued with a new passport but failed to notify the police.

Between November 23, 2016, March 7 2017, with him being subject to the requiremen­ts of Part the Sexual Offences Act, he failed to notify police within three days of obtaining a new passport.

Burke last year told officers that he didn’t own a passport.

However, on March 8 this year he attended a police office and advised officers that he was in possession of a passport and had been so since November last year.

Under his requiremen­ts he is bound to inform the police of any changes in his circumstan­ces within three days.

Defence solicitor David Fitzpatric­k told the court how Burke, who had previously been given a community payback order was engaging well with its requiremen­ts.

He added:“It wasn’t a flagrant breach. He was open and honest with police.”

SheriffWyl­lie Robertson said:“It’s of the utmost importance that you know what your requiremen­ts are and that you comply with them.

“I appreciate that you raised it with the police but this is a serious matter.

“I will impose a fine but that will have to reflect the gravity of the charge.”

Burke was fined £700.
