Kids abuse pics man is back in dock over breach
A Killearn man who was convicted of possessing pornographic images of children but failed to comply with court requirements has been brought back before a sheriff.
Craig Burke, 38, from Wellgreen, Killearn, appeared at Stirling Sheriff Court on Wednesday (September 20) after he was issued with a new passport but failed to notify the police.
Between November 23, 2016, March 7 2017, with him being subject to the requirements of Part the Sexual Offences Act, he failed to notify police within three days of obtaining a new passport.
Burke last year told officers that he didn’t own a passport.
However, on March 8 this year he attended a police office and advised officers that he was in possession of a passport and had been so since November last year.
Under his requirements he is bound to inform the police of any changes in his circumstances within three days.
Defence solicitor David Fitzpatrick told the court how Burke, who had previously been given a community payback order was engaging well with its requirements.
He added:“It wasn’t a flagrant breach. He was open and honest with police.”
SheriffWyllie Robertson said:“It’s of the utmost importance that you know what your requirements are and that you comply with them.
“I appreciate that you raised it with the police but this is a serious matter.
“I will impose a fine but that will have to reflect the gravity of the charge.”
Burke was fined £700.
